1. Introduction and Acceptance
These Terms of Service ("Terms") form a legally binding agreement between you ("User," "you," or "your") and Axiom, a trading name operated by Gigabite, a sole proprietorship registered in Singapore ("Axiom," "we," "us," or "our").
By purchasing, downloading, installing, or using Axiom Basket Manager v2 ("the Software"), you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree to these Terms, do not purchase, download, or use the Software.
2. Eligibility
To use the Software, you must:
Be at least 18 years of age
Have the legal capacity to enter into a binding contract under the laws of your country of residence
Not be prohibited from using financial tools or trading software under the laws of your jurisdiction
Have an active MetaTrader 5 ("MT5") trading account with a licensed broker
By using the Software, you represent and warrant that you meet all of the above requirements. Axiom reserves the right to terminate your license without refund if any eligibility requirement is found to be unmet.
3. Description of the Software
Axiom Basket Manager v2 is a trade management tool designed for use on the MetaTrader 5 (MT5) platform, intended for the XAUUSD (Gold/US Dollar) trading pair and compatible instruments.
The Software does NOT: open trades automatically, make trading decisions on your behalf, constitute financial advice, or guarantee any level of profit or protection from loss.
The Software DOES: assist in managing trades that you place manually, providing basket management, layering, and trade organisation tools. You are solely responsible for all trading decisions.
4. License Grant
Subject to these Terms and payment of the applicable subscription fee, Axiom grants you a limited, non-exclusive, non-transferable, revocable license to install and use Axiom Basket Manager v2 on your MT5 terminal for personal, non-commercial use only. This license is tied to your MT5 account number provided at registration and may not be shared, resold, or sublicensed.
5. Subscription, Payment and Billing

5.2 Payment Processing
All payments are processed securely by Stripe. Axiom does not store your credit card information. By subscribing, you authorise Stripe to charge your selected payment method on a recurring basis.
5.3 Automatic Renewal
Subscriptions renew automatically at the end of each billing period. You may cancel at any time through your billing portal to prevent the next renewal charge.
5.4 Price Changes
Axiom reserves the right to change subscription pricing with at least 14 days' written notice sent to your registered email address.
6. Refund Policy
⚠️ No-Refund on Activation: Once you download and activate the Software using your MT5 account number, your purchase is considered fulfilled and no refund will be issued for the current billing period. Digital software cannot be "returned" once accessed.
6.2 Prorated Refunds on Cancellation
If you cancel your subscription before the end of your current billing period and have not yet downloaded or activated the Software in that period, you may be eligible for a prorated refund for unused days. If you have already downloaded or activated the Software, no refund will be issued for that period. Future unbilled periods will not be charged upon cancellation.
6.3 Exceptions
Refunds may be considered at Axiom's sole discretion in cases of duplicate charges caused by a billing error, or charges made after a confirmed cancellation. Contact Axiombasketmanager@gmail.com within 7 days of the charge with your order details.
7. User Responsibility
You acknowledge and agree that trading foreign exchange, commodities, and related instruments involves substantial risk of loss. You are trading with your own capital and are solely responsible for any financial losses incurred. Axiom is not responsible for any loss of funds arising from your use of the Software. You should only trade with money you can afford to lose entirely.
You are solely responsible for setting appropriate risk parameters for your account size, understanding how each setting affects your exposure, monitoring your trades while the Software is active, and ensuring your broker's margin requirements are met at all times. Axiom provides no guidance on appropriate risk settings for your individual situation.
Your relationship with your broker is entirely separate from your relationship with Axiom. Axiom is not responsible for broker outages, slippage, execution issues, broker insolvency, or margin calls.
8. Prohibited Uses
You agree not to: reverse engineer or decompile the Software; share, resell, or sublicense the Software; use the Software on an account that does not match your registered MT5 account number; use the Software for any unlawful purpose; or represent that you are affiliated with Axiom without written authorisation. Violation may result in immediate license termination without refund.
9. Intellectual Property
The Software and all related materials are the intellectual property of Axiom and its operators. All rights are reserved. These Terms do not transfer any ownership rights to you.
10. Disclaimer of Warranties
The Software is provided "as is" and "as available" without warranties of any kind. Axiom does not warrant that the Software will be error-free, uninterrupted, compatible with all brokers, or achieve any specific trading result.
11. Limitation of Liability
To the maximum extent permitted by applicable Singapore law, Axiom shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including trading losses, arising from your use of the Software. In no event shall Axiom's total liability exceed the total subscription fees paid by you in the three (3) months preceding the event giving rise to the claim.
12. Governing Law
These Terms are governed by the laws of the Republic of Singapore. Any dispute shall first be addressed through good-faith negotiation, and if unresolved within 30 days, submitted to the Singapore Mediation Centre before any legal proceedings are initiated.
